Asphalt concrete plants use equipment to produce asphalt concrete by batching or drum mixing aggregates, sand and other materials in certain proportions, then heating and coating the mixture with a binder such as bitumen or tar. Equipment used at an asphalt concrete plant includes rotary dryers, screens, elevators, silos, weight hoppers (batchers), drum mixers, cold feed bins, conveyors, mixer engines, asphalt cement storage heaters, pollutant control devices and auxiliary generators.

Effective July 3, 2018, asphalt concrete plants are eligible to operate in Florida under the terms of an air general permit (AGP) pursuant to the requirements of Rule 62-210.310(4)(g), Florida Administrative Code (F.A.C.)

An AGP is an authorization by rule to construct or operate a specific type of air pollutant emitting facility. Use of such authorization by any individual facility does not require action by the Florida Department of Environmental Protection (DEP). The terms and conditions of an AGP are set forth in the rule, rather than in a separately issued air construction or air operation permit.

Can I apply for an asphalt concrete plant AGP if I am currently operating under an air operation permit?

Owners/operators of asphalt concrete plants that are currently operating under an air operation permit, but meet the eligibility requirements of the AGP rules, may elect at any time to surrender their operation permit and register for an AGP.  An air operation permit is surrendered concurrently with the AGP registration.  To avoid lapse of authority to operate, if you plan to use an AGP, you must submit the proper registration and fee at least 30 days prior to the expiration of the existing air operation permit. 


If I surrender my air operation permit and register for an AGP, will I receive a partial refund of the application fee for the operation permit?

Permit application fees will not be refunded if an owner/operator elects to surrender their permit before it expires. 


What is the benefit of surrendering an air operation permit years before it expires to register for an AGP?

Registering for an AGP sooner than the expiration of an air operation permit may be beneficial as AGP facilities are not required to submit an annual operation report (AOR).


If I surrender my air operation permit for an AGP, do I still have to submit an AOR for the portion of the year I held the air operation permit?

No, unless the compliance authority specifically requests that it be submitted to verify eligibility for the AGP.


Can I have an asphalt concrete plant AGP and collocate with other permitted facilities?

Asphalt concrete plants registered as a stationary or relocatable AGP facility may collocate with other asphalt concrete plants, concrete batching plants, or nonmetallic mineral processing plants that are registered under separate AGPs, provided the production and fuel usage conditions outlined in 62-210.310(4)(g)(4), F.A.C., are met. 

The owners/operators of all collocated asphalt concrete plants, concrete batching plants, and nonmetallic mineral processing plants shall maintain records to account for site-wide asphalt concrete production and fuel consumption for each collocated unit for each calendar month and each consecutive 12 months.

Asphalt concrete plants registered as a relocatable AGP facility may also collocate with other (non-AGP) permitted facilities to perform non-routine tasks, such as making asphalt concrete for a construction project.  The owner/operator of such asphalt concrete plant shall keep records to indicate how long the plant has been at the permitted facility.

Compliance Assistance Information

Asphalt concrete plants registered as relocatable AGP facilities are required to complete a Facility Relocation Notification Form and submit it to the appropriate compliance authority each time they relocate to a new site.
